Welcome to Inertia360! These Terms of Service ("Terms") govern your use of our web applications and services. By accessing or using any Inertia360 application, you agree to be bound by these Terms.
Important: Please read these Terms carefully. If you do not agree to these Terms, you may not use our services.
1. Acceptance of Terms
By creating an account or using any Inertia360 service, you confirm that:
- You are at least 16 years old
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations
- You agree to our Privacy Policy
2. Service Description
2.1 What We Provide
Inertia360 offers free web-based applications, including but not limited to:
- Inertia360 Flashcards: A tool for creating and studying flashcards with spaced repetition
- Future applications: Additional productivity and learning tools as they become available
2.2 Free Service Limitations
Our services are provided free of charge and operate on limited resources. This means:
- Service may be temporarily unavailable if usage limits are exceeded
- We use Firebase's free tier, which has daily quota limits
- Performance and availability are provided on a "best effort" basis
- Features may be added, modified, or removed at our discretion
3. User Accounts
3.1 Account Creation
To use our services, you must:
- Provide a valid email address
- Create a secure password
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized access to your account
3.2 Account Responsibilities
You are responsible for:
- All activity that occurs under your account
- Keeping your password secure
- Ensuring your account information is accurate and up-to-date
- Any content you create, upload, or share using our services
3.3 Account Termination
You may delete your account at any time through the application settings. We reserve the right to suspend or terminate accounts that:
- Violate these Terms
- Engage in abusive or excessive usage
- Are inactive for extended periods (we will provide notice first)
- Pose a security risk to our services or other users
4. User Content and Conduct
4.1 Your Content
You retain all ownership rights to the content you create (e.g., flashcards, study materials). By using our services, you grant us a limited license to:
- Store and display your content as necessary to provide the service
- Backup your content for service reliability
- Process your content to enable application features
This license ends when you delete your content or account.
4.2 Prohibited Content
You agree NOT to create, upload, or share content that:
- Is illegal, harmful, threatening, or abusive
- Infringes on intellectual property rights of others
- Contains malware, viruses, or malicious code
- Violates privacy rights or contains personal information of others without consent
- Is spam, commercial solicitation, or advertising (unless authorized)
4.3 Prohibited Activities
You agree NOT to:
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use automated tools (bots, scrapers) without permission
- Reverse engineer, decompile, or attempt to extract source code
- Interfere with or disrupt the service or servers
- Use the service for any illegal purpose
- Abuse the free tier limits through excessive usage or multiple accounts
5. Service Availability and Changes
5.1 Service Availability
We strive to provide reliable service, but we do not guarantee:
- Uninterrupted or error-free service
- Specific uptime or availability percentages
- That the service will meet your specific requirements
- Protection against all security vulnerabilities
5.2 Service Modifications
We reserve the right to:
- Modify, suspend, or discontinue any feature or the entire service
- Change these Terms with reasonable notice (see Section 11)
- Implement usage limits or restrictions as necessary
- Perform maintenance with or without notice
5.3 Data Backup
Important: While we implement reasonable backup procedures, you are responsible for maintaining your own backups of important data. Use the export features to save copies of your content.
6. Intellectual Property
6.1 Our Rights
Inertia360, including its design, code, features, and branding, is owned by us and protected by copyright and other intellectual property laws. You may not:
- Copy, modify, or create derivative works of our applications
- Use our branding, logos, or trademarks without permission
- Claim ownership of our intellectual property
6.2 Your Rights
You retain all rights to content you create using our services. We do not claim ownership of your flashcards, study materials, or other user-generated content.
7. Third-Party Services
Our services may use third-party providers (such as Google Firebase for hosting and authentication). Your use of these services is also subject to their terms of service and privacy policies. We are not responsible for third-party services or their actions.
8. Disclaimers and Limitations of Liability
8.1 "AS IS" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:
- Merchantability and fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of content
- Continuous, uninterrupted, or secure access
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INERTIA360 SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or other intangible losses
- Service interruptions, errors, or downtime
- Unauthorized access to or alteration of your data
- Actions or content of third parties
Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed $50 USD.
8.3 Educational Use Disclaimer
Our flashcard and learning applications are tools for study and practice. We make no guarantees about learning outcomes, exam performance, or educational results. Users are responsible for verifying the accuracy of all content they create or study.
9. Indemnification
You agree to indemnify and hold harmless Inertia360 from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your use or misuse of the service
- Content you create, upload, or share
10. Privacy and Data Protection
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. When we do:
- We will update the "Last Updated" date at the top of this page
- For significant changes, we will provide notice within the application or via email
- Continued use of the service after changes constitutes acceptance of the new Terms
- If you do not agree to the changes, you should stop using the service and delete your account
12. Dispute Resolution and Governing Law
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
12.2 Dispute Resolution
Before filing any legal claim, you agree to first contact us to attempt to resolve the dispute informally. Most disputes can be resolved this way.
12.3 Arbitration
Any dispute that cannot be resolved informally shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Inertia360 regarding the use of our services and supersede any prior agreements.
15. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.
By using Inertia360 services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
